By utilizing this site, you agree to these TestifyingExpert.com Terms of Service (“Terms”). These Terms govern all activities of any site user (“Customer”), whether the Customer is one who creates listings (“Listing Customer”) or one who browses/searches listings (“Browsing Customer”).
The Customer agrees to provide accurate, current and complete information about themselves and their organization as prompted by the registration forms. Customers must maintain the confidentiality of passwords and other information related to the security of their account. Customers must keep all registration information as current as accurate as possible. Customers are fully responsible for all use of their account and for any actions that take place through their account. If a Customer is utilizing the services offered by this site on behalf of another party, company, or organization, the Customer represents and warrants that their actions are authorized by such party, company or organization, and are authorized to bind such party, company or organization to these Terms.
Listing Customers are offered the ability to upload, store, publish, display and distribute information, text, photos, videos, and other content on or through the listing that they create (“Listing Content”). Listing Content includes any content posted by the Listing Customer and users of the Listing Customer’s account. The Listing Customer is solely responsible for any and all Listing Content. The Listing Customer represents and warrants to TestifyingExpert.com that they have all necessary rights to post or distribute such content, and their distribution of such Listing Content does not infringe or violate the rights of any third party. The Listing Customer agrees that they will not knowingly upload any content or files that contain malware, spyware, or any other malicious code that may harm or threaten any computers, software, or data used by TestifyingExpert.com or its Customers. The services offered by this Web site do not comply with the U.S. Health Insurance Portability and Accountability Act (“HIPAA”). Customers are solely responsible for compliance with all applicable laws governing the privacy and security of personal, medical, and/or sensitive data that is listed or communicated through this site. Listings may not include inappropriate content that includes but is not limited to sexually explicit, obscene, profane, threatening, or unrelated promotional content.
TestifyingExpert.com disclaims all liability for the material presented in any Listing Content, and does not guarantee its accuracy, completeness, reliability, or currency. The content is published “as is”, and does not represent the official views and/or opinions of TestifyingExpert.com. The Customer agrees to indemnify, defend and hold TestifyingExpert.com and all of its associated parties harmless from any and all claims and/or demands. This includes attorneys’ fees resulting from any use, misuse, harm, or omission by the Customer. TestifyingExpert.com merely provides an online space for its Customers to share information about their expertise and services. Browsing Customers should verify all Listing Content when accuracy is required. Any reliance upon the Listing Content shall be at the Customer’s own risk. TestifyingExpert.com has no obligation to and does not regularly review the substance of the content posted in listings, and is therefore not responsible for any of such content. All Customers grant TestifyingExpert.com a non-exclusive, worldwide, royalty-free right and license to collect, use, copy, store, transmit, modify, and create derivative works of the data volunteered by and gathered from the Customer, solely to the extent necessary to provide services related to those provided by TestifyingExpert.com.
The position of listings in the search results is determined by many variables and search rankings are determined by proprietary software. Since we do not manually control each individual search, we do not offer any guarantee on search ranking position. Any search ranking estimates offered for listings may include some variance. While we strive to achieve a high level of accuracy, we offer no guarantee or warranty on the accuracy of our search ranking estimates.
Customers reserve the right to keep their contact information hidden from other site users until they decide to make it available to requesting parties. Only registered site users may request contact information from listings. Contact information will not be displayed publicly and will only be provided to requesting site users upon the owner’s approval.
After verifying their phone and email address, listing Customers may begin building and previewing their listing at no cost and without a payment method on file. Listings that do not have a payment method on file will not be visible to other site users. Once a payment method is added, the listing will become an "Active Listing" where it becomes visible to all site users, and a 30-day trial will begin. After 30 days have passed without being cancelled, the payment method will be charged the monthly listing subscription fee.
TestifyingExpert.com reserves the right to change prices and fees at any time. A monthly renewal fee is required for every Active Listing.
Some listings may offer detailed information where extended access is required. To gain extended access, a one-time fee is required for each user who is attempting to access the information, in accordance with the extended access fee at the time of the request. Once extended access is purchased for a listing, it does not expire as long as the requesting Customer’s account is active. The default payment method will be charged before extended access fee will be allowed.
All fees are non-refundable when paid except as otherwise provided herein. Additionally. TestifyingExpert.com will not provide refunds for any services that are unused.
The advertised fees include any applicable sales, use, revenue, excise or other taxes imposed by any taxing authority with respect to the Services provided herein.
Listing Customers who have decided to begin a paid monthly subscription, authorize TestifyingExpert.com to charge the monthly statement balance to the default payment method provided by the Listing Customer. The monthly statement balance may include, but is not limited to, the monthly subscription fee and any remaining balance resulting from paid promotions. The credit card transaction will be processed automatically each month, or when the paid promotion bill has reached the billing threshold as specified in the terms herein. This authority will remain in effect until the Listing Customer cancels their listing subscription. Cancellation may be completed using the TestifyingExpert.com Dashboard or by contacting Support.
Each Listing Customer has the option to boost their ranking in the search results by paying for promotions. A listing may be promoted in each of its selected specialty categories. Listings will only incur promotion fees when they are clicked while located in the “Sponsored” section of the search results or the category listings. Listings that are included in the search rankings without promotion will not incur any promotion fees when clicked by a user. While efforts are made by us to ensure that only one click will be billed for each unique user, we offer no guarantee that each billed click is executed by a completely unique user. A daily spending limit may be set by the Listing Customer to limit the amount billed each day. When the daily spending limit is reached, the promoted listing is removed from the “Sponsored” section of the search results or the category listings.
Each Customer with an active listing has the option to increase the visibility of their listing by purchasing featured ads. A listing may be featured in each of its selected specialty categories, which will position the listing at the beginning area of the search results and directory for the chosen category. A listing may also be featured on the home page of this web site, in which the listing will appear in the section of the home page that is designated for featured listings. The position of a listing within the featured sections is determined using the Listing Completion score that can be found on the Dashboard of each customer's account. Featured listings must be paid in advance and are billed at the beginning of each Customer's monthly billing cycle. Prorations are used for new featured listings where less than a month is remaining before the next billing. Featured listing will be charged regularly on the monthly billing date of the listing subscription, and will continue until the featured listing is cancelled by the Customer. Upon cancellation, the featured listing will continue to be displayed until the end of the monthly billing cycle, in which time it will be removed. No prorations or refunds are available for featured listings that are cancelled before the monthly billing date.
Listing Customers may discontinue their monthly paid subscription for their listing at any time. TestifyingExpert.com reserves the right to continue utilizing the information volunteered by the Customer, and may keep listings from cancelled subscriptions active in the search results and category lists. In the event that a Browsing Customer attempts to contact the Listing Customer through a cancelled listing, the Listing Customer will be notified and the listing must be reinstated before they may access their account again to receive any messages. An additional fee will be required before the listing is reinstated, and is determined by the number of months since the last monthly payment. Customers may request full listing and data removal by contacting Support.
Reviews may only be provided by those who possess working experience with the Listing Customer in which the review is written about. TestifyingExpert.com reserves the right to moderate and possibly decline review submissions that contain inappropriate content, which includes but is not limited to unrelated, sexually explicit, obscene, profane, threatening, or promotional content. Otherwise, TestifyingExpert.com will not act as a mediator of any sort in disputes between parties, and will not decline submissions that provide value for other site users.
TestifyingExpert.com reserves the right to deny service to any party for any reason and without notification. Failure to adhere to the Terms herein may result in the cancelation and removal of the Customer’s account.
Florida law shall apply to any remedies and/or disputes related to these Terms. The only venue for any legal action shall be Hillsborough County, Florida.
